blue-check 3 methods for selection of investors of commercial housing projects under the Law on Housing

For the period before the date on which 2020 Law on Investment takes effect (January 1st, 2021), the selection of investors in commercial housing projects shall be carried out according to Clause 2 Article 22 of 2014 Law on Housing, including 3 methods:

(1) Holding land auction

(2) Inviting bids for land-using projects

(3) Appointing investors

At Article 18 of Decree No. 99/2015/ND-CPstatus2 also regulates in details the application of the aforesaid 3 methods for selection of investors in commercial housing projects.

In which, it is required to note that in an area where land clearance and compensation is not completed and there are multiple qualified investors registering, the bidding method for selection of investor shall be applied. If there is only one qualified investor, the method of appointing investors shall be applied.
