Decision No. 1399/QD-TCHQ dated July 15th, 2022 of the General Department of Customs on promulgating a pilot program for encouraging voluntary compliance with customs laws by enterprises

For the purpose of supporting enterprises to prevent customs offences and improve degrees of compliance with customs law, the custom sector will develop a Program for provision of support for enterprises, including these activities: counseling, response to difficulties, provision of information and warnings against risks for enterprises during their import/export activities, etc.

The Program shall be executed in 2 phases:

- Pilot phase: the Program is executed within 2 years from the date on which it is issued; in the end of the pilot phase, a pilot summary shall be made for assessment of and amendments to the Program to meet realistic requirements.

- Official execution phase: the Program is executed after the pilot phase ends, preliminaries shall be organized for 1 time every year within 5 years and the Program shall organize a summary to assess the result of the Program and orientation to execute the Program in the next phase.

Support may be provided via phone, email or in writing depending on each enterprise’s requirements and the nature of the case.

Entities eligible to participate in the Program include enterprises whose head offices are located in Vietnam, run their import/export operation for over 365 days and selected by customs authorities.

Customs authorities will sign a Memorandum of Understanding (MoU) with enterprises that apply for participating in the Program.

This Decision takes effect from the date of its signing.
