According to clause 2 Article 5, Article 54, Article 55 of the Law on Real estate trading No. 66/2014/QH13
and Article 4 of Decree No. 02/2022/ND-CP, a real estate investor is entitled to sell, lease or lease purchase off-plan houses, buildings when he/she meet regulatory requirements.
However, the Law on Real estate trading does not regulates that the investor, before entering an agreement on sale or lease purchase of an off-plan building, has to submit an application to the Department of Construction for granting a document to recognize the building eligible for sale, lease purchase.
Regarding contract for purchase, sale, lease purchase of houses and construction works, applying Form No. 04 issued together with Decree No. 02/2022/ND-CP .
