Official letter No. 1631/BXD-QLN dated May 12th, 2022 of the Ministry of Construction regarding application for modifying a construction project

Based on Article 4 of Law No. 03/2022/QH15, the Ministry of Construction notes that in case an investor only has the right to use land for trading and service, it is not eligible for approval of investment policy at the same of approval for investor of the commercial housing project; it is required to hold a bidding to select investor.

One of the conditions for approval of investment policy and approval for the investor of the commercial housing project at the same time according to Article 4 of Law No. 03/2022/QH15 is that the investor must have the right to use residential land and other types of land other than residential land that meet requirements for change in purpose of land use for execution of the project.
