Official letter No. 473/TCHQ-PC dated February 6th, 2023 of the General Department of Vietnam Customs regarding handling administrative violations

The General Department of Vietnam Customs notes that with regard to the act of importing goods without a license though the import license is compulsory shall be sanctioned according to clause 1, clause 3 Article 18 of Decree No. 128/2020/ND-CP .

In particular this act shall be subject to a fine ranging from VND 2,000,000 to VND 50,000,000, depending on value of violated goods.

In addition, it is also subject to remedial measures. Accordingly, the violator is compelled to:

(i) remove the violated goods from the territory of Vietnam within 30 days from the date on which the decision on penalty imposition is received (except for exports and imports licensed within the aforementioned time limit);

(ii) pay an amount equal to the value of the exhibits that have been sold, concealed and disguised or destroyed against the law.
