Official letter No. 4423/TCHQ-PC dated August 24th, 2023 of the General Department of Vietnam Customs regarding application of legislative documents to impose penalties on administrative violations

According to the regulations at Article 6 of the Law on Handling administrative violations No. 15/2012/QH13 , statute of limitations for handling of administrative violations regarding production of, export of, import of, trading goods; producing and/or trading prohibited, fake goods shall be 02 years.

The application of legislative documents to handle administrative violations shall be carried out according to the principles regulated at Article 156 of the Law on Promulgation of Legislative Documents No. 80/2015/QH13 . Accordingly, in case a new legislative document does not contain legal liability or impose a less serious legal liability on the acts committed before the effective date of the document, the new document shall apply.
