Official letter No. 6183/BKHDT-KTDPLT dated August 2nd, 2023 of the Ministry of Planning and Investment regarding guidelines on some contents in the course of arrangement of administrative units of district level, commune level in the 2023 -2030 period

This Official letter instructs the approval of public investment projects; reviewing to make adjustments to planning; determination of areas eligible for investment incentives; adjustments to projects; adjustments to enterprise registration certificate, etc. due to rearrangement of districts, communes in the 2023 -2030 period under Resolution No. 35/2023/UBTVQH15 .

Accordingly, in case the rearrangement of districts, communes in the 2023 -2030 period causes changes of areas eligible for investment incentives, the determination of areas eligible for investment incentives in case of change of administrative divisions shall be carried out according to Article 21 of Decree No. 31/2021/ND-CP .

If the rearrangement of districts, communes in the 2023 -2030 period effects investment incentives which investors are enjoying, it is needed to consider implementing the investment guarantee according to the regulations at Article 13 of the Law on Investment and Article 4 of Decree No. 31/2021/ND-CP .

If the rearrangement of districts, communes changes information about location of execution of an investment project, the investor shall follow procedures for adjusting the investment project according to the regulations at clause 2 Article 41 of the Law on Investment and clause 2 Article 4 of Decree No. 31/2021/ND-CP .

Procedures making adjustments to the enterprise registration certificate due to changes in administrative divisions shall be carried out according to the regulations Decree No. 01/2021/ND-CP and instructional documents.
